Dumping duty on fluorescent lamps recommended

NEW DELHI, Nov. 6

THE Designated Authority in the Commerce Ministry has recommended imposition of preliminary anti-dumping duty on imported compact fluorescent lamps (CFL) from China and Hong Kong.

In its preliminary notification issued here, the Authority said that it received a written petition from Indo Asian Fusegear Ltd and Osram India Ltd, alleging dumping of CFL from the subject countries. After examination, the Authority found that imports from subject countries had increased from 18.25 lakh units in 1998-99 to 46.74 lakh tonnes in 1999-2000 and to 153.99 lakh tonnes in 2000-01. The market share of the subject countries in total imports had increased from 40 per cent in 1998-99 to 94 per c ent in 2000-01.

Despite the increase in installed capacity by one of the petitioners, actual production came down by 0.22 lakh units in 2000-01 compared to 32.21 lakh pieces in 1999-2000. Sales have registered a negative growth of seven per cent. Closing stocks had gon e up by around 145 per cent during the period of investigation over the previous year and the capacity utilisation during the period of investigation was as low as 20 per cent, it said.

In view of the injury inflicted to the domestic industry by the deluge of imported CFL from the subject countries, it was decided to recommend provisional anti-dumping duty equal to the margin of dumping or less which if levied would remove the injury to the domestic industry.

Accordingly, the anti-dumping duty per unit without choke for Philip & Yaming Lighting Co and all other exporters from China should be the difference between $1.426 and $3.115 with choke per unit. In the case of CFL imported from Hong Kong, the anti-dump ing duty should be the difference between $1.426 and the landed price of imports per unit without choke.
