TN: Samadhan scheme to expedite disputed property registrations

CHENNAI, Sept. 30

THE Tamil Nadu Government has announced a Samadhan scheme involving 40 per cent remission of the difference of stamp duty paid and the stamp duty payable on the value of the property as proposed by the registering officer, according to a Government order dated September 26.

The scheme will be in operation between October 1 and November 29.

The objective is to release the crores of rupees that the Government will earn and that is blocked, and enable the public to get back the registered documents pending as on April 18, 2002.

Under the scheme, the party concerned will have to pay 60 per cent of the difference of the duty paid and the stamp duty payable on the value of the property.

There will not be any site inspection or inquiry by the Special Deputy Collector (Stamps).

The scheme covers the documents pending with the Special Deputy Collector (Stamps)/Sub Registrar for determination of market value under Sec. 47-A/19(B)(4) of the Indian Stamp Act.

The documents are referred to the Special Deputy Collection (Stamps) after registration when the value of the property set forth in the document by the registrant is below the guideline value in respect of lands or below the PWD Schedule of Rates in the case of buildings, and the registrant refuses to pay the difference.

According to the Inspector General of Registration, 94,718 documents are pending determination of market value as on March 31, 2002. In 2000 and 2001 over 53, 364 documents had been referred to Special Deputy Collector (Stamps).

Since it is not possible to appoint additional staff to speed up the work, the Government has decided to implement the scheme following the suggestion of the Inspector General of Registration, according to the Government.

The registration fee shall be collected proportionately as specified in the second proviso to Article 1 of the Table of fees issued under Section 78 of the Registration Act, 1908 (Central Act XVI/1908).

The stamp duty and the registration fee payable under the scheme shall be collected in the Sub-Registrar office itself.

The scheme will not be applicable to cases pending for recovery of arrears under the Revenue Recovery Act.

The Tamil Nadu Government had earlier announced a Samadhan Scheme, which was open for seven months between March and September 1999.
