Airport development fee at Delhi, Mumbai legal, says Court

New Delhi, Aug. 26 The Delhi High Court has held that the Airport Development Fee (ADF) being charged at Delhi and Mumbai airports is legal.

Dismissing petitions on Wednesday, including one filed by the Resources of Aviation Redressal Association, the court said: “There is no illegality in ADF. They (Delhi International Airport Ltd and Mumbai International Airport Ltd) have obtained the Centre’s permission for that.”

Private stimulus

It added that stopping the airports from collecting the fee would frustrate the Government policy of involving private participation in the sector.

The petitioners had alleged that the consortia did not have the authority to charge the fee.

The Division Bench that gave the judgment was headed by Chief Justice A.P. Shah.

The development fee

Domestic passengers travelling from Delhi pay Rs 200 towards ADF while an international passenger is charged Rs 1,300. In Mumbai, a domestic passenger pays Rs 100 and an international passenger, Rs 600.

In February, the Centre had granted permission to the consortia to charge ADF for a limited period and prescribed the manner in which the funds can be utilised.

Welcoming the verdict, a DIAL spokesperson said: “The ADF is levied for a limited period to develop the airport and provide modern, passenger-friendly facilities.”
