Corporate Disputes Birla case: `Pansari has no locus standi' Our Legal Correspondent
Kolkata , Dec. 14 THE hearing of the petition filed by Mr S.N. Prasad, one of the accused seeking quashing of the proceedings pending in the Alipore court (in the R.S. Lodha matter) has now started in the court of Mr Justice D.P. Sengupta of the Calcutta High Court. Earlier, on December 8, on the plea of Mr Prasad, Mr Justice Sankar Prosad Mitra (Justice in absentia for Mr Justice D.P. Sengupta) stayed the proceedings till December 16 and fixed the case for hearing today. Mr Pradip Ghosh, counsel for Mr Prasad, stated that proceedings being initiated by Mr R.P. Pansari should be quashed as he had no locus standi to start such proceedings against Mr R.S. Lodha, Mr S.N. Prasad, Dr Gaurishankar and Mr S.K. Daga. It was stated that Mr Pansari, the complainant, was in no way connected with the will in question made by Priyamvada Devi Birla. Mr Ghosh further stated that the allegation of Mr Pansari about suppression of fact and breach of trust also do not have any basis. In the complaint, Mr Pansari had admitted that on April 15, 1989, Priyamvada revoked all the five Trusts, and all the assets and liabilities of M.P. Birla estate were transferred solely to Priyamvada; making her the sole beneficiary of the M.P. Birla estate. Hence, the question of suppression of fact, as alleged, does not stand.
