Court refuses search warrant against Lodha

THE Chief Judicial Magistrate of Alipore, in South 24 Parganas district of West Bengal, Md Mumtaz Khan, today refused to pass any order of search warrant against Mr R.S. Lodha, a member of the M.P. Birla Trustee Board. The court also did not pass any such order against Mr S.N. Prasad, Dr V. Gauri Shankar and Mr S.K. Daga, all members of the trustee board.

Acting on application of complaint filed by one Mr R.P. Pansari on October 5, the court issued summons asking the trustees to appear before it today. Noted lawyer Mr Ram Jethmalani moved the application of alleged conspiracy to revoke the trust deed made by M.P. Birla and Priyamvada Birla. In the deed, M.P. Birla and Priyamvada Birla wanted that all the assets of their estates should be vested in public charity through trusts. These trusts are the M.P. Birla Trust, P.D. Birla Trust, P.D. Birla Fund, P.D. Birla Kosh and P.D. Birla Nidhi. Properties of these trusts have been vested in three charitable institutions, namely Hindustan Medical Institutions, Eastern India Education Institutions, and M.P. Birla Foundation. Mr Pansari, being the honorary secretary of all three charitable institutions, had said in his complaint petition that Mr Lodha was claiming that all the assets of M.P. Birla estates have been bequeathed to him by way of revoking all the trusts created by M.P. Birla. Mr Lodha had taken away entire property by practicing fraud, the complainant alleged.
