Anti-dumping The `officialese' on an anti-dumping probe
As per a trade notice issued by the Ministry of Commerce and Industry, on behalf of the Directorate General of Anti-Dumping and Allied Duties, the "examination of the impact of the dumped imports on the domestic industry concerned, shall include an evaluation of all relevant economic factors and indices having a bearing on the state of the industry, including natural and potential decline in sales, profits, output, market share, productivity, return on investments or utilisation of capacity, factors affecting domestic prices, magnitude of the margin of dumping, actual and potential negative effects on cash flow, inventories, employment, wages, growth and ability to raise capital investments". As per the suggested proforma for making application for anti-dumping investigation by domestic industry, the application should invariably contain data relating to the proposed period of investigation (POI) and previous three financial years. It has been pointed out that there should be no gap, though there can be an overlap between the POI and the previous financial years. The data for previous three years, it is clarified, would be utilised for a trend analysis to determine the injury. The source of data must also be indicated. It is further clarified that any information furnished on a confidential basis should be supported by a statement of reasons to demonstrate the good cause as to why the particular information has to be kept confidential.
