Corporate Disputes HC order on notarised version of Birla will tomorrow Our Legal Correspondent
Kolkata , Aug. 30 MR Justice Kalyan Jyoti Sengupta on Monday concluded the hearing of the application filed by Mr G.P. Birla, Mr K. Tapuria and Mr P.K. Khaitan seeking to produce notarised photocopy of the will of M.P. Birla and Priyamvada Birla. Mr Justice Sengupta will pass the order on Wednesday. Mr B.K. Birla filed a petition for addition of party in the probate petition of the Priyamvada Birla. The court will hear the petition on September 1, 2004. Today's arguments mostly revolved around two factors. First, whether a probate hearing could be conducted on the photocopy of a will. Both the sides cited several laws, regulations and precedents in support of their arguments. Second, the Birlas stated in their application that they were not filing the original copy the will of M.P. Birla and his wife Priyamvada (signed in 1982) in the court as they apprehended that it might be leaked to the media. Mr Justice Sengupta and the legal team of Mr Rajendra Singh Lodha took strong objection to it. The lawyers representing the Birlas agreed to delete that portion from their petition.
