Augmentin patents: Ranbaxy guarded

NEW DELHI, May 24

EVEN as the markets are agog with the opportunity that may open up for generic versions of GlaxoSmithKline's drug Augmentin, Ranbaxy, one of the company's on whom the spotlight falls, prefers to watch developments before charting its course.

Senior officials at Ranbaxy told Business Line that given that GSK has appealed against the ruling, "the company's future course will be governed by the outcome of the appeal.''

While GSK feels that the decision on its recent appeal would take another 12-18 months, pharma industry watchers observe that in the last 10 months alone, there have been two rulings. They expected a decision on the recent appeal in another 4-6 months. Augmentin is a $2 billion drug in the US and clocks about $3 billion globally. But whether generics from Ranbaxy and others would be able to eat into this pie is a question that can be answered only when the court rules on GSK's appeal, market watchers opine.
