Calcutta HC alters stay on jute packaging order

KOLKATA, May 15

THE Calcutta High Court has modified its order staying the implementation of the Government's notification to reduce usage of jute packaging for sugar to 90 per cent from 100 per cent.

Mr Justice P.C. Ghose, in his order, said the modification was to the extent that Central Government Core Cabinet Committee presided over by the Prime Minister could hold a meeting to discuss the issue and take a decision, but no effect of the decision shall be given effect to without the leave of the court.

Mr Justice Ghose, in his earlier order, stayed the notification dated March 1, 2002, issued by Ministry of Textiles where the Central Government had decided to reduce the use of jute packaging for sugar on the basis of recommendations made by the Standing Advisory Committee under order No.S.O.853(E) dated September 1, 2001.

The Additional Solicitor General (E.R.) prayed for vacating the order passed on April 25. He argued that the issue related to the Government's policy. The matter shall be placed before Parliament before enactment.

The Advocate General, appearing for the State Government, supported the contention of the writ petition.

The Indian Jute Mills Association (IJMA) filed a writ petition challenging the Central Government notification, saying the Jute Packaging Materials (compulsory use in packaging commodities) Act, 1987 was enacted for compulsory use of jute packaging materials in the supply and distribution of certain commodities and the Supreme Court had upheld its validity in 1996.
