Governance by ordinance

This refers to the article `Governance by ordinance' (Business Line, January 18). The issue of ordinances, a device to frame laws during the inter-session period of Parliament, is a perfectly legal tool. The opposition to POTO does not sustain, considering the fact that equally strong laws are in force in some States. The point that the law is liable to misuse is no justification to oppose the measure.

Are there any laws that cannot be misused? Misuse can only be prevented if adequate safeguards against arbitrary and unjustified use are incorporated. Various governments have resorted to issuing ordinances and have taken almost the same, or similar, steps as the ones now being criticised.

Criticism is necessary for the healthy functioning of democratically-elected governments. But the `any stick is good enough to beat' attitude towards any government run by any party or combination of parties can be only counter- productive.
